[Roster Case at Madras CAT | Won]


We have won the Roster case filed by our Legal Team in Madras CAT. The Hon`ble Tribunal has directed BSNL to expedite the promotion process of JTO to SDE with proper post-based roster within 6 months.

This will have far-reaching impact on our career prospects. We will be uploading details once we receive a copy of the Order.

[EPF Case | High Court of Madras dismissed BSNL`s Case | A Victory]


Hon`ble Madras High Court has dismissed BSNL`s case against payment of EPF Subscription for Direct recruits during Training period.
     Orders will follow soon. Please watch this space, we`ll post the orders as soon as they are issued.
     We congratulate AIGETOA legal team for their excellent work in securing this Court Order.

[Roster Case Listing Update | High Court of Madras]


*The Update on Roster Case heard on 13.06.2011 by Hon`ble CAT,Madras Bench:* The case pertaining to the post-based roster case listed before the Hon`ble CAT, Madras Bench for the final hearing. The BSNL/Promotee Association Counsels argued that AIGETOA being a Direct Recruit Engineers` association has no locus standi on filing the court case on promotions from JTO to SDE and association filed the case with the ill-intention of stopping promotion to other promotee candidates in BSNL. How ever, owing to effective presentation of our counsel hon`ble members of CAT did not accept this argument of respondents and confirmed that AIGETOA is within their rights to file this case. Our opponents tried their best to vacate the status quo order but failed to convince the Hon`ble members of CAT.

During the argument the legal team of AIGETOA learned that BSNL and others have filed a writ petition in the Hon`ble Madras High Court for stay on the CAT orders and failed to get any relief and suitably directed back to CAT by the Hon`ble High Court without any merits. This shows the ill intentions of the Management and other associations towards the Direct Recruitees. Instead of fightinging nobly, they ventured to find another escape route from the genuine rights of Direct Recruitees. *If the post-based rosters were implemented, 50% vacancies of SDE has to be filled from the list of direct recruited JTOs.*

It is sad to mention that BSNL had given a written statement on 18.03.2011 that roster updating is taking place. According to them, `roster updating being a complex exercise cannot be completed instantly.` Strangely, on 04.06.2011 BSNL submitted another written statement contradicting their earlier statement that roster is already updated on 18.02.2011.

The current working strength of SDE is 25,500 against the sanctioned strength of 18,000. Our legal team counsel promptly pointed out all of these contradicting statements of BSNL to the Hon`ble Members of the CAT. Our counsel argued that a bogus roster would have been prepared after the DPC held for the promotion orders issued on 30.03.2011. On hearing this Hon`ble Members of the CAT asked BSNL to submit the Minutes of the DPC held so far from the year 2006 to 2011 to verify whether the roster was updated prior to the earlier DPC`s and current DPC. AIGETOA legal team is also permitted to verify the Rosters. It may be noted that this is the first time the rosters will be submitted to any judicial and quasi judicial authorities by BSNL for SDE(T) cadre. AIGETOA`s legal team assures our members that it will leave no stone unturned until it achieves its objective of better career growth to the members of AIGETOA.

[EPF (Pre-Recruitment) Case | High Court of Madras]

EPF Issue for Pre-Recruitment (induction training) period was listed today at the High Court of Madras. BSNL`s Counsel was of the opinion that `the pre induction training period given to GEJTO/DRJAO for 10 weeks by the BSNL neither a training nor an apprentices, it is just like a railway ticket given to the candidates who appear in the examinations.`

On hearing this rather unusual argument, the Honourable Judge commented that it is BSNL HR managers who need training in labour management! Countering BSNL Counsel`s argument, The Honourable Judge pointed out that BSNL, a large public sector undertaking, should acknowledge and honour its social obligations rather than echo the policy followed by private companies. AIGETOA`s Legal Team effectively assisted our (AIGETOA TN Circle`s) counsel for the case and helped convice the Judge that pre-recruitment training is a part of official duty. The Honourable Judge reserved the judgement to a later date.

Winning the case will entail financial benefit to the tune of Rs 10,000-15,000, which will be credited to the EPF accounts of DR JTOs/JAOs. An additional 3 to 4 months will be added to the computation of pension benefits.

[Meeting with CGM, April 27, 2011 | Details]

A meeting was held between CGMT, Kerala and AIGETOA on 27th April 2011 at CGMT office, Trivandrum. On BSNL side CGM, GM (Admn) and DGM (Admn) was present and AIGETOA was represented by Circle secretary, Circle President and others.

The meeting was held to appraise the CGM of HR, Operational and Marketing related issues prevalent in BSNL, Kerala.

[Chennai CAT Order | A Victory]


Chennai CAT has stayed the new SDE promotion list issued by Corporate Office in the roster case for not meeting the 1:1 criterion (the ratio of promotees to direct recruits should be 1:1).

This will increase the chance of DR JTOs becoming SDEs through promotion.

[MNP Status | Kerala Circle]


We have consolidated data from IMPCS regarding the impact of MNP n BSNL in Kerala. Surprisingly, the good performance of a single SSA (Kannur) has resulted ina net increase of a few thousand connections (port-in). Almost all other SSAs have had more numbers going out. Significant among these is Malappuram and Thrissur (see graph).

In this regard, we also note a slight increase in net landline connections in Kerala for the month of February, 2011. The increase is mainly due to additions in Kollam SSA. We hope that this is an authentic increase in the number of connections, in which case it reflects a resurgence in BSNL landline popularity. Landline is of central importance to the survival and market viability of BSNL as our main revenue source (wired-line and broadband); GSM is not nearly as profitable as wired line (per-connection revenue being in the range of Rs 150 in GSM, whereas wired-line revenues are twice as much).

[EPF Accounts]

PLEASE NOTE!
Employees Provident Fund Organisation (EPFO) India is stopping payment of interest on all inoperative EPF Accounts from April 1, 2011. (An inoperative EPF account is one on which there has been no transaction for 36 months.)

All BSNL recruited JTOs/JAOs/TTAs holding inoperative EPF accounts (those who have been transferred at least once between SSAs) should do the following.
  1. Fill in and submit Form-13A, if they have been transferred from one unit to another unit.
  2. In case of multiple transfer, fill up and submit Form-13A for each new EPF Account.

[Pay Upgrade]

BSNL Corporate Office has withdrawn its earlier order pertaining to "Time Bound scale upgradation under Executive Promotion Policy on revised and provisional IDA pay scales of executives as per 2nd PRC". The Order says:
  1. The first and subsequent IDA pay scale upgradation will be provisionally granted to the executives working in the provisional IDA pay scale of E1/E1A and E2/E2A scale ...
  2. ... (the) first IDA pay scale upgradation, in the cases of all those executives whose pay do not touch/cross the lowest of the higher IDA pay scale in four years, will be given from the due date on which their basic pay in the current IDA pay scale touch/cross the lowest of the higher IDA scale or after completion of six years of service in the current IDA pay scale, whichever is earlier.
    1.     This will directly benefit JTOs of the 2005 batch, as well as avoid any pay anomaly in the case of JTOs recruited after 2005..

'The Executive Meeting of AIGETOA, Kerala Circle, was held on March 6, 2011 at Adhyapak Bhavan, Eranakulam. An open session was conducted in the afternoon, from 11:00 am to 2:00 pm. The session was well-attended, with participation from all over Kerala. AIGETOA President, Mr Shiloh Rao, addressed the open session. In his speech, Mr Rao emphasized the need to stay united. He stressed the role of DR JTOs in the current state-of-affairs.'

Excerpts from the address by Shri Shiloh Rao:
'AIGETOA is a good platform where u can actually excel yourself by being with the organization. It is an organization meant for you. I would like to address few issues, like these days issues are coming up batchwise, first it was 2001 with EPF issue, then it was 2005 batch: they said we were the most unfortunate batch in the entire BSNL history, now after getting fitment that word is gone and they are the most luckiest batch. And, now again the same with 2007 batch onwards, they are saying that they are the most unfortunate batch because nobody takes care of us.
     'For all the batches, the problem here is: it is not who is taking care, the problem is how you come forward and deliver. It is not that no body is stopping you from joining AIGETOA, I always say Please Come, Please Come take positions and make your voice heard. And until and unless you don't make a call on yourself that I wish to be a part of AIGETOA, no body can help you. You will have to come forward, take your responsibility and trust your circle leadership...'

[Transfer Policy]

Here are the long-stay particulars for TVM SSA (including Circle Office). The list was put out in 24 Nov 2010. Similar lists have been issued in Kollam and Ernakulam SSAs. Circle body executives who took part in deliberations last year with CGMT, GM (HR) and AGM (HR) may recall the promise made by the officers regarding transfer policy (see entry March 16, 2010). A beginning seems to have been made.
    We thank the Circle level BSNL Management for delivering on their promise in implementing the transfer policy. This is a hopeful first step in ensuring justice to the young executives in BSNL.



[Circle Meeting]

AIGETOA Kerala will conduct its Circle Committee Meeting on 06-03-2011, Sunday, at 10:00 am at Adhyapak Bhavan, Karikkumuri Cross Road, (Near to Eranakulam South Railway Station).
    The Meeting will be addressed by NJP Shiloh Rao, President, AIGETOA. All delegates are requested to attend the meeting and make it a grand success.
